Scope of this Policy

Thank you for visiting Dio Technologies, owned and operated by Dio Technologies, Inc. (referred to as “Dio,” “us,” “our,” “we”). We are committed to respecting privacy rights and concerns and have established and implemented this Privacy Policy to inform visitors of our website and mobile application (collectively, the “Services”) and our customers of what personal information we collect, and how we use, share, and protect such information. If you have any questions regarding this information or our privacy practices, please see the section entitled Contact Us at the end of this Privacy Policy.

Agreement to Terms

This Privacy Policy explains our information practices. Our Terms of Use govern your use of the Services. Where applicable law requires consent to a particular use of your information, we obtain that consent separately; this Privacy Policy does not replace that consent.

Effective Date and Changes to this Policy

This Privacy Policy is effective as of the date above and will remain in effect until a new policy supersedes it. We may update it from time to time. The most recent version is identified by the effective date at the top of this page. For a material change, we will provide a conspicuous notice through the Services or an email address associated with your account. Where required by applicable law, we will obtain consent before using information for a new purpose.

The Information We Collect

Depending on your relationship with us, the types of personal information we collect and process about you can include:

  • Personal identifiers, such as your first and last name, email address, phone number, account username and password, shipping and billing address, online identifier, Internet Protocol address, unique device identifiers, marketing preferences, correspondence, your comments and reviews, hobbies/interests as part of your account, payment card or bank account information;
  • Commercial information, including your purchase history, warranty and support information;
  • Contest, promotion or survey information, when you choose to participate;
  • Internet or other electronic network activity information, including browsing history and search history, and information regarding your interaction with a website application; and
  • Geolocation information;

We collect such personal information directly from you when you visit and use features of the Services; register for a user account; participate in a contest, promotion, or survey; purchase products from us; or when you otherwise contact us.

You are not required to provide all personal information identified in this Privacy Policy to use our Services or to interact with us, but certain functionality will not be available if you do not provide certain personal information. For example, if you do not provide certain personal information, we may not be able to respond to your requests, provide you with products, or provide you with marketing that we believe you would find valuable.

Cookies

We and our partners use cookies, pixels, browser storage and similar technologies to operate our website, remember preferences, understand visits and interactions, measure marketing and referrals, and support advertising. Some technologies are required for requested services; others support analytics or marketing.

  • Necessary technologies: Help operate the shopping cart, checkout, account sign-in, security and other requested functions.
  • Functional technologies: Remember preferences and support features such as forms, reviews and notifications that you choose to use.
  • Analytics technologies: Help us understand website use and marketing performance, including pages visited, referring sources, interactions and purchases. We use services including Google Analytics and Triple Whale for these purposes.
  • Advertising and referral technologies: Help measure advertising, show relevant ads and attribute purchases to referring partners. These include Google and Meta advertising tools and affiliate/channel attribution through Awin and Grommet.

Cookies can last for a browsing session or remain on your device between visits. Their duration varies by purpose, provider and settings; closing your browser does not necessarily delete them. Browser storage and other tracking technologies may operate differently from cookies.

Microsoft Clarity

We use Microsoft Clarity for behavioral analytics, heatmaps and session replay to understand website use and improve our services. Clarity collects website interaction and device information, such as page URLs, clicks, scrolling, browser details and visitor identifiers, through cookies and similar technologies. Microsoft collects or receives personal data through Clarity and may use it for its own purposes, including Microsoft Advertising and improving its products and services. Dio and Microsoft each determine purposes for their respective use of this information. Learn more in the Microsoft Privacy Statement.

For Google's information practices, see How Google uses information from sites or apps that use its services. For Awin's information practices, see Awin's privacy policy.

Google may also use Analytics data shared under our Google products & services setting to understand online behavior and improve its products and services, as described in its privacy information.

You can manage cookies through your browser settings. Blocking or deleting necessary cookies may affect functions such as sign-in or checkout. Browser controls do not necessarily stop every form of tracking, including information already sent to a provider. You can also use the Google Analytics opt-out browser add-on and applicable provider advertising choices. See Your Privacy Choices below.

We may use analytics technologies, including Google Firebase Analytics, in our App to collect technical information and information about how App features are used. This may include interaction events, App and device information, and identifiers. We use this information to understand and improve the App and its features, subject to applicable consent requirements and your choices. Device permissions, such as camera or location permissions, control the corresponding device features and do not necessarily disable analytics. Website browser choices apply to the browser in which they are made; see Your Privacy Choices below for other available choices.

Device Information

Similar to cookies, we may automatically collect certain information about the device you use to access the Services. For example, we may collect and analyze information such as IP addresses, geolocation information, unique device identifiers, browser types, browser language, operating system, the state or country from which you accessed the Services, and other information about your mobile phone or other device(s). In addition to analytical purposes, this information helps us diagnose problems with our server, administer the Services, and display the content according to your preferences.

Do Not Track

Dio respects your privacy, but we do not alter the information we collect or change the Site upon receiving “do-not-track” signals, as the term appears in Cal. Bus. & Prof. Code §§ 22575(b)(5). For more information about DNT signals, visit http://allaboutdnt.com.

Children’s Privacy

The Services are not intended for users under the age of 13. We do not knowingly or intentionally gather personal information about visitors who are under the age of 13. If you are aware of, or suspect that, someone under the age of 13 is using the Services without permission, please notify us immediately by contacting us as detailed below. If you have questions or concerns about the Internet and privacy for your child, we encourage you to check out the FTC Guidelines for protecting your child’s privacy online.

How We Use Your Personal Information

We use or otherwise process your personal information to:

  • Manage your relationship with us;
  • Respond to your inquiries or requests, complaints, and request feedback;
  • Provide goods or services requested by, or reasonably anticipated by, you;
  • Provide you with relevant promotional materials or information about the company, its products, its outcomes, and opportunities to get more involved;
  • Publicize your reviews and blog comments for promotional purposes;
  • Administer contests, promotions or surveys;
  • Analyze your use of the Services;
  • Analyze the hobbies or interests that you provide in order to understand how we can provide relevant updates to our Services;
  • Detect security incidents and protect against malicious, deceptive, fraudulent, or illegal activity or prosecute those responsible; and
  • Comply with legal requirements.

How We Share Your Personal Information

Our online store is hosted by Shopify. Shopify processes information about visits, orders and customer interactions to provide its services. See the Shopify Consumer Privacy Policy for its information practices and the Shopify Privacy Portal for choices available directly from Shopify.

Shopify also uses information from interactions with our store together with information from your interactions with other merchants and Shopify to provide enhanced services, including features that improve and protect our business and other merchants' businesses. For these services, information is shared with Shopify and relevant third parties, which may be located in other countries. Shopify's Consumer Privacy Policy and Privacy Portal explain these uses and choices available directly from Shopify.

We also use providers for email and push communications, signup forms, reviews, referrals and warranty services, including Brevo/PushOwl, CWILL, Judge.me, Shopjar/RecomSale and SureBright. Depending on the service and your interaction, these providers process contact details, website activity, order information or service requests. Analytics, advertising and affiliate providers receive the information described under Cookies. Some providers process information on our behalf; others also use information for their own purposes under their privacy policies.

We share your personal information with the following categories of third-parties, where applicable:

  • Advisers and financial institutions, including, legal, tax, auditors, risk and compliance, notaries, and business continuity support services;
  • Service providers and suppliers, including, IT outsourcing, marketing, customer management, shipping vendors, and payment processors. In some instances, service providers will be directly responsible to you for their use of your personal information. They may be obliged by law to provide you with additional information regarding the personal information that they hold about you and how and why they process that information. Further information may be provided to you in a separate notice or may be obtained from such service providers directly, for example, via their websites;
  • Public, if you submit a review or comment for publication on the Services;
  • Where permitted by applicable laws, with third-parties in connection with a corporate restructuring, sale, transfer or assignment of assets or business, merger, divestiture, or other changes to the company’s control or financial status (or any of our affiliates); and
  • Government bodies and dispute resolution and law enforcement organizations, as applicable.

If you have questions about the parties with which we share personal information, please contact us as specified below.

Your Privacy Choices

Where available, you can also use our data-sharing opt-out page. You can visit Shopify’s Privacy Portal for choices relating to Shopify’s use of your information.

Use the Privacy Choices control on our website to review or change your browser permissions for website analytics, advertising and optional preferences. These choices apply to the browser in which you make them; they do not change your email subscriptions or choices for the Dio App. Necessary technologies remain available for shopping, checkout and security. Changing a browser choice does not delete information already collected. You can use the other choices described in this section or contact us about uses outside that browser control.

Registering a warranty does not by itself sign you up for marketing. Our warranty registration provides a separate marketing opt-in. Where required, we obtain consent before sending promotional communications. Withdrawing marketing permission does not affect your warranty or prevent necessary order, warranty or support communications.

Depending on applicable law, you may have rights to request access to, correction of or deletion of personal information, or to withdraw consent or object to certain uses. Contact us at info@dioconnect.com to make a request or ask about your choices. We may need to verify your identity and retain information needed for legal obligations or legitimate transaction, warranty and dispute purposes. Applicable legal rights are not limited by the account or published-content limitations described below.

If you no longer want to receive our newsletter, emails or other marketing communications, you may unsubscribe at any time by following the “unsubscribe” link at the bottom of our emails, or by writing to us as detailed below. Please note that you cannot unsubscribe from certain correspondence from us, including messages relating directly to your account.

With exceptions, you may be able to view, amend, or delete your information by changing your user settings in your user account by contacting us using the details below or logging in with your username and password. Please note that publicized reviews or comments may not be subject to change or deletion. To cancel your account, you can contact us as detailed below. Please note that unless specified otherwise, cancelling your account alone, will not delete your information.

How We Store and Safeguard Your Information

We keep personal information for as long as needed for the purposes described in this Policy, including providing requested services, administering transactions and warranties, resolving disputes and meeting legal obligations. Retention varies by the information and purpose.

We and our providers may store or process information in the United States and other countries where we or our providers operate. Information processed in another country may be subject to that country's laws and lawful access by its authorities.

We maintain reasonable technical and organizational measures to protect personal information from loss, misuse, alteration, or unintentional destruction. Your personal information is only accessible, on a need to know basis, by a limited number of employees who have special permissions. Unfortunately, the transmission of information via the Internet is not completely secure. Although we will do our best to protect your personal information, we cannot guarantee the security of your information as it is transmitted to us. To the extent permitted under applicable law, we assume no liability or responsibility for disclosure of your information due to errors in transmission, unauthorized access by third-parties, or other causes beyond our control.

You play an important role in keeping your information secure. You should not share your username or password for your Dio account with anyone. If you have reason to believe that your account is no longer secure, please contact us immediately as detailed below.

Third-Party Links

In an attempt to provide increased value to our visitors, we may choose various third-party websites (e.g., contributors, vendors, information partners) to link to within our Services. We have no control over these linked sites, each of which has separate privacy and data collection practices independent from us. As such, we have no responsibility or liability for these independent policies or actions and are not responsible for the privacy practices or the content of any such websites.
